Terms of Engagement
These Terms of Engagement (“Terms”) define the standards of care, compliance, and commercial basis governing all work performed by Nextrend Systems Sdn. Bhd. All services, deliverables, access rights, warranties, and obligations are provided strictly in accordance with the issued invoice.
Purpose & Scope
These Terms apply to all engagements with Nextrend, including audio dashboards, system commissioning, service visits, digital platforms, and concierge support.
The issued invoice constitutes the primary and binding agreement between Nextrend and the client.
- The invoice defines the scope of work, deliverables, site location, fees, and service duration.
- Any service not expressly stated on the invoice is excluded unless later invoiced in writing.
- These Terms apply in conjunction with the invoice, and where there is any inconsistency, the invoice shall prevail.
Malaysian Law & Jurisdiction
Use of Dashboards
Access to dashboards, portals, and tuning interfaces is provided only for services invoiced.
Clients must:
- Follow installation, tuning, and safety instructions issued by Nextrend engineers.
- Refrain from using remote access or monitoring features for unlawful surveillance or recording.
- Acknowledge that third-party services (e.g. streaming platforms, voice assistants) are governed by their own terms.
- Restrict dashboard access to authorised personnel associated with the invoiced project.
Nextrend may suspend access if usage exceeds or deviates from the invoiced scope.
Intellectual Property
A non-exclusive, non-transferable licence is granted solely for use at the site and purpose stated on the invoice. Reproduction, reverse engineering, resale, or redistribution is prohibited without prior written consent.
Fees & Payment
- All charges are invoiced in Ringgit Malaysia (MYR).
- Payment terms are strictly as stated on the invoice (default: 30 days from invoice date).

Limitation of Liability
To the maximum extent permitted under Malaysian law:
- Nextrend shall not be liable for indirect, incidental, or consequential losses, including loss of profit, data, or business opportunity.
- Nextrend’s total aggregate liability shall not exceed the total amount paid under the relevant invoice, or the fees paid in the twelve (12) months preceding the claim — whichever is lower.
